Terms of Service

These Terms of Service ("Terms") are a binding agreement between you ("you" or "Customer") and Expert Book Design LLC, a West Virginia limited liability company doing business as BookDesignerAI ("BookDesignerAI," "we," "our," or "us"), governing your use of the BookDesignerAI website, applications, and services (collectively, the "Service").

By creating an account, uploading a manuscript, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

BookDesignerAI is an AI-assisted book design service. We help you transform a manuscript into print-ready and digital book files, generate custom cover artwork, produce marketing materials, and store the resulting work for download. We use third-party artificial intelligence providers to process your content. See our Privacy Policy and Sub-processors · Accessibility Output Files page for details.

2. Eligibility

You must be at least 16 years old to use the Service. If you are using the Service on behalf of a business or other entity, you represent that you have authority to bind that entity to these Terms.

3. Account creation and security

To use most features of the Service you must create an account. You agree to provide accurate, current, and complete information at registration and to keep that information current. You are responsible for safeguarding your account credentials and for all activity that occurs under your account. Notify us promptly at cantos@bookdesigner.ai of any unauthorized use.

4. Pricing, billing, and refunds

Current prices are listed on the Pricing section of our website and within the Service. All purchases are one-time. We accept payment through PayPal; PayPal's terms apply to that payment relationship.

The following refund policy applies to all purchases:

Refunds are self-service from your Account page → Purchase History. PayPal Buyer Protection (180 days) applies in addition to this policy.

Pursuant to EU and UK Consumer Rights Directive 2011/83/EU Article 16(m), you expressly consent at purchase to immediate commencement of digital content processing and acknowledge the resulting loss of the standard 14-day right of withdrawal once processing begins. The voluntary refund policy described above remains in effect notwithstanding that consent.

5. Your intellectual property

You own your work. All manuscripts, cover artwork directions, metadata, and other content you upload to the Service remain your property. BookDesignerAI claims no copyright, ownership, license-back, or other interest in your creative content, your finished book, or any derivative works you create using the Service.

You retain full ownership of the formatted book files (PDF, DOCX, ePub) and any cover artwork generated for your project. You are free to publish, sell, distribute, license, and copyright your finished book in your own name without further permission from us.

Our compose pipeline does not add a BookDesignerAI copyright line to your book's copyright page. The only attribution we render is an optional "Design Assisted by BookDesignerAI" credit, which you can remove from Book Details before formatting.

6. License to us (limited and for the purpose of providing the Service)

You grant BookDesignerAI a limited, non-exclusive, worldwide, royalty-free license to use, store, copy, transmit, modify, and create derivative works of your uploaded content solely to the extent necessary to (a) operate the Service for you, (b) transmit your content to third-party AI providers to produce the outputs you request, and (c) maintain backup copies for your benefit. This license terminates when you delete the content from your account or when your account is deleted, except to the extent retention is required by law (e.g., financial records).

7. AI-generated output

The Service uses third-party AI providers to read, analyze, and generate content based on your inputs. AI output is probabilistic. We do not warrant that AI-generated content will be free of errors, omissions, or stylistic choices you disagree with. You are responsible for reviewing all AI-generated output before publishing it. You agree that the Service is a creative-assistance tool, not a substitute for human editorial review of work you intend to publish.

The AI providers we work with do not use your inputs or outputs to train AI models. See our Privacy Policy for details on AI data handling.

8. Acceptable use

Your use of the Service is also governed by our Acceptable Use Policy. Violations may result in suspension or termination of your account, refusal to process specific content, and where required by law, reporting to authorities.

9. Storage and retention

We keep your project files (manuscripts, output files, and project metadata) on our systems and a backup mirror while your account is active, so you can download them whenever you need. We recommend keeping your own copy of your final files as a backup. You can delete all your data at any time from your Account page.

10. Service availability; no warranties

We make commercially reasonable efforts to maintain Service availability but do not promise uninterrupted operation. The Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including without limitation any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will meet your requirements or that any errors will be corrected.

11. Limitation of liability

To the maximum extent permitted by applicable law, in no event shall BookDesignerAI or its affiliates, officers, directors, employees, agents, suppliers, or licensors be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages — including but not limited to loss of profits, loss of data, loss of goodwill, work stoppage, or computer failure — arising out of or related to your use of the Service, even if advised of the possibility of such damages.

Our total cumulative liability arising out of or relating to these Terms or the Service shall not exceed the greater of (a) the amount you paid us in the twelve months preceding the event giving rise to the claim or (b) one hundred United States dollars ($100). Some jurisdictions do not allow the exclusion or limitation of certain damages; in those jurisdictions, the foregoing limitations apply to the maximum extent permitted by law.

12. Indemnification

You agree to indemnify, defend, and hold harmless BookDesignerAI, Expert Book Design LLC, and our affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of (a) content you upload or distribute through the Service, (b) your violation of these Terms or the Acceptable Use Policy, (c) your violation of any rights of a third party including intellectual property or privacy rights, or (d) your violation of any applicable law.

13. Termination

You may terminate your account at any time through the Account page, including by selecting "Delete my entire account" under Data privacy. We may suspend or terminate your account immediately and without notice if you violate these Terms or the Acceptable Use Policy, if we are required to do so by law, or if continued provision of the Service to you exposes us to legal or operational risk.

Upon termination, the licenses granted to you in these Terms cease. Provisions of these Terms that by their nature should survive termination (including Sections 5, 7, 8, 11, 12, 14, and 15) will survive.

14. Changes to these Terms

We may update these Terms from time to time. Material changes will be posted on this page with an updated "Last updated" date. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service and may delete your account.

15. Governing law and dispute resolution

These Terms are governed by the laws of the State of West Virginia, United States, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Service shall be brought exclusively in the state or federal courts located in West Virginia, and you consent to the personal jurisdiction of those courts. Nothing in this section affects your statutory consumer rights under the law of your country of residence.
